“I am filing a lawsuit to protect abortion access in our state… These bold actions are necessary for the most desperate of times, and we must get this done before Roe is potentially overturned.”

On April 7, 2022, Governor Gretchen Whitmer proactively filed a lawsuit to secure a preliminary injunction against a 1931 abortion ban still on the books in Michigan.

In response to the lawsuit, Governor Whitmer stated, “I am filing a lawsuit to protect abortion access in our state, and I am using the Executive Message — a tool that is rarely used but held by the governor’s office — to urge the Michigan Supreme Court to swiftly decide this matter. These bold actions are necessary for the most desperate of times, and we must get this done before Roe is potentially overturned. Michiganders need to know now whether abortion will be legal and accessible in our state, and if our basic freedoms are protected. My actions in court are designed to provide that clarity.”

“We hold that Roe and Casey must be overruled.” A Politico exclusive shocked the nation. An initial draft majority opinion written by Justice Samuel Alito was leaked to Politico, unveiling the Supreme Court’s vote to strike down the 1973 Roe v. Wade decision, which guaranteed federal constitutional protections of abortion rights, and the 1992 Planned Parenthood v. Casey decision, which maintained that right.

Alito pushed the future of abortion access to the states, writing, “It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.”

After the Supreme Court draft decision was leaked, Governor Ron DeSantis responded during a news conference by saying, “I hope, I know they launched an investigation, so they need to figure out who did that, and they need to hold them accountable because that is a real, significant breach of trust. We are also anticipating that when our protections go into effect July 1, that will be subject to a state constitutional and statutory challenge. There is case law that’s out there that we would have to overcome to be able to sustain those protections. I think we can do it, but I do think that’s going to be something that is going to happen once the law takes effect. So we’ll see what the federal, U.S. Supreme Court does.”

“I’m going to fight like hell to protect access to safe, legal abortion in Michigan.”

Michigan State Judge granted a preliminary injunction in a suit brought by Planned Parenthood against Michigan’s unconstitutional 1931 law criminalizing abortion, blocking enforcement of the abortion ban.

In response, Governor Gretchen Whitmer stated, “I want every Michigander to know: no matter what happens in DC, I’m going to fight like hell to protect access to safe, legal abortion in Michigan.”

Lawsuits challenging House Bill 5, which bans abortion after 15 weeks of pregnancy, were filed ahead by Planned Parenthood, the American Civil Liberties Union, a handful of abortion providers, and the Congregation L'Dor Va-Dor of Boynton Beach for violating religious freedom.

Governor Whitmer urges Michigan Supreme Court to take action and make it clear that abortion is protected in Michigan.

“Getting this done will put an end to any confusion and ensure that Michiganders, health providers, and prosecutors understand the law.”

Governor Whitmer sent a notice to the Michigan Supreme Court, urging them to immediately consider her lawsuit to decide if Michigan’s state constitution protects the right to abortion.

She said in a press release on the notice, “In the wake of the decision in Dobbs overturning Roe, certain county prosecutors and health providers have expressed confusion about the current legal status of abortion in Michigan. Florida’s 15-week abortion ban is reinstated as law after legal battle.

Governor DeSantis’ office states, “We reject this interpretation because the Florida Constitution does not include — and has never included — a right to kill an innocent unborn child,” after the initial court order halted the 15-week abortion ban.

A Florida state judge issued an order temporarily halting the 15-week abortion ban after reproductive health providers argued that the state constitution guarantees the right to the procedure.

The state of Florida appealed the order, automatically triggering a stay of the injunction under Florida state law. The law went back into effect just days later.

During a press conference in Putnam County, Florida, Governor DeSantis compared the standing Florida Supreme Court precedents on abortion rights to laws in communist China and North Korea.

During this press conference, Governor DeSantis stated he believed the Florida Supreme Court would reverse a ruling from 1989 that the state Constitution’s privacy clause protects access to abortion completely through the first trimester.

On August 10, Governor Whitmer filed a motion for a preliminary injunction against the 1931 abortion ban in Oakland County Circuit Court. Days later, the court rules that county prosecutors can’t enforce the 1931 abortion ban, protecting access to abortion in Michigan until the state supreme court reaches a decision and voters decide on the constitutional ballot.

A Florida state judge issued an order temporarily halting the 15-week abortion ban after reproductive health providers argued that the state constitution guarantees the right to the procedure.
